YOU MAY PRINT THESE PAGES FOR YOUR RECORDS. BY ACCESSING THE WEBSITE, I UNDERSTAND AND AGREE THAT I MAY BE WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN.

ELIGIBILITY:

Fantasy Feud fantasy sports leagues offered by Fantasy Feud Inc. (each, a “League” or collectively, the “Leagues”) are open to legal residents of the United States and the District of Columbia (excluding the States of Arizona, Iowa, Louisiana, Maryland, Montana and Vermont) who have reached the age of 18 years (19 years in the States of Alabama and Nebraska) at the time of entry. Employees of Fantasy Feud Inc. (“Fantasy Feud”) or other parties involved in any aspect of the creation, production, operation, execution and fulfilment of a League are not eligible to participate in leagues for cash prizes. Participation in any League constitutes your agreement to these Terms and Conditions and the rules for the League (for each League the “League Rules”).

HOW TO ENTER:

Each League is available to any person who is eligible and who: (i) registers on the Website and becomes a member; (ii) completes the registration process on the Website; (iii) meets the qualifications set forth in these terms of use; and (iv) affirmatively accepts these Terms and Conditions and the associated privacy policy.

Each type of League is described in the “Description of Leagues” section below. Each such League varies in duration, lasting either one (1) day or one (1) week, as predetermined and set forth in that League’s Rules. Drafts for each League may vary and the description of such drafts is discussed in the “Drafts” and “Description of Play” sections below.

Each League will only have a limited number of openings, and entrants will be accepted on a first come, first serve basis. Any League which does not attract the requisite minimum number of participants will be cancelled prior to commencement.

There is no limit to the number of Leagues which a User may participate in at any time.

Fantasy Feud is not responsible for attempted League registrations that are lost, late, illegible, misdirected, damaged, incomplete or incorrect, or for your failure to participate in, or complete, a scheduled League. If you fail to enter a League, including without limitation where you cannot access the Website for any reason whatsoever, you will not be able to participate in that League. A User’s access to and use of the Website or any of the content located on the Website is at the User’s risk and the sole and exclusive remedy is to discontinue accessing and using the Website.

PRIZES and eStore:

Individuals who participate in a League (each, a “User” or collectively, the “Users”) may purchase any denomination of electronic credits (a “Credit” or “Credits”, as the case may be) which are fully redeemable towards the purchase of goods sold in Fantasy Feud’s online store (the “e-Store”). Upon purchase of Credits, the exact denomination of purchased Credits will be automatically deposited into the User’s account for redemption in the e-Store. All purchases made by a User in the e-Store will be subject to the e-Store’s Terms and Conditions, which may be found by clicking here.

DRAFTS:

When a League has attained the necessary number of Users required by the applicable League Rules, the Users will then be able to participate in an online draft (each, a “Draft”) for a League using the Website’s interface, whereby each User will select players from the applicable professional sport’s league or team, as the case may be, (collectively, the “Athletes” or individually, an “Athlete”) and assign those Athletes to the User’s team. Once an Athlete is selected by a User, that Athlete will not be available for drafting by any other User in that League during the applicable League duration, unless otherwise provided for in that League’s Rules. Users will have 60 seconds to make a Draft selection pursuant to that League’s Rules. Users may select an “Auto Draft” option that allows them to pre-select Athletes in order such that if a User fails to make a selection in the allotted time, the Auto Draft feature will automatically select the next Athlete on the User’s list or, where the User did not customize his/her list, from the Website’s own predetermined list.

Description of Play:

Snake Draft

In any Snake Draft Room, the draft order will be randomly selected and will follow a “snake” model whereby the order will proceed from 1 to 10 (or such other total number of Users in the applicable Draft), then 10 to 1 (as applicable) until the Draft is complete. As a result, the User who drafts last in one round will draft first in the immediately following round, the User who drafted second-to-last in such earlier round will draft second in such immediately following round and so forth such that the User who drafted first in such earlier round will draft last in the immediately following round. Each User will have 60 seconds to make his/her draft selection.

In the Instant Snake Draft format, as soon as the Draft Room is populated with the maximum number of permitted players in that particular Draft Room, the draft of Athletes will begin immediately.

In the Time Snake Draft format, Users will sign up to participate in a Draft that will begin at the time indicated in respect of that particular Draft Room.

The number of Athletes eligible to be drafted will vary depending on the particular sport. Snake drafts may be daily contests or weekly contests. In a Daily Snake Draft, the contest will end at 11:59 p.m. in the latest time zone where any Athlete drafted by any Player has completed play, such that no Athlete is still active and eligible to play in a sports game on that particular calendar day. In a Weekly Snake Draft, the contest will end at 11:59 p.m. in the latest time zone where any Athlete drafted by any Player has completed play, such that no Athlete is still active and eligible to play in a sports game on the calendar day which is one week from the day on which the contest began.

Once a Draft Room is filled, the Draft order will appear on the top of the screen and you will see a countdown to Draft time at the top of the Draft Room.

Salary Cap

In the Salary Cap Draft, Athletes are designated a unique fictional monetary value based on a variety of factors, including historic performance, current matchup, weekly matchups, location of game play, etc. These values are calculated by a computerized statistical generator, and are subject to change based on a number of variables related to the Athlete’s historic and anticipated future performance.

In a Salary Cap Draft, the draft order will be randomly selected and each User will be allotted a certain amount of Draft dollars which he/she can use to bid for Athletes against the other Users. The roster size of Athletes for each User in a given League will be predetermined and set forth in the applicable Rules.

Pro Pickem

In the Pro Pickem Draft, Users will be presented with categories of Athletes in the particular sport to which the League applies. The Athletes which comprise each category will be selected at random.

PRIZES:

Each User will earn points based on the performance, during the applicable League duration, of the Athletes that were drafted on his/her team. The specific scoring system for each League, and the number of winners, will be predetermined and set forth in the applicable League Rules. Fantasy Feud will be responsible for tallying the points for each League based on the reporting of Athlete performance provided by each professional sporting league. The winner(s) of any League, as determined by Fantasy Feud, will receive the applicable prize to be paid out as a deposit into the User’s Fantasy Feud account. Users can withdraw this money from their accounts via the request of a check or through their PayPal® account; provided, however, that PayPay® may deduct a service fee in connection with such deposits. The User is responsible for paying any sales, use, income or other taxes related to prizes (including, without limitation, from the eStore) awarded to the User in connection with any League.

The value of the prize per League will be a pre-determined fix amount, which will vary depending upon which League the User participates in. League prize pools will be maintained by Fantasy Feud in a separate trust account, and Users will not be entitled to receive a larger prize by reason of the fact that other Users have applied Credits in order to participate in the League. Users should check the description of each League for a description of its particular prize prior to entering.

The payout structure for League prize pools will be as follows:

Leagues with 2 – 4 Users: 1st place – 100%
Leagues with 5 – 9 Users: 1st place – 65%; 2nd place – 35%
Leagues with 10 – 19 Users: 1st place – 55%; 2nd place – 30%; 3rd place – 15%
Leagues with 20 or more Users: 1st place - 45%; 2nd place - 25%; 3rd place - 20%; 4th place - 10%

The winner(s) of a Free League will receive Credits in proportion to the structure set out above, which will be awarded in denominations of 10 Credits for every User who participated in such Free League. All Credits will be automatically deposited into the User’s account for redemption in the e-Store. All purchases made by a User in the e-Store will be subject to the e-Stores Terms and Conditions, which may be found by clicking here. The User is responsible for paying any sales, use, income or other taxes related to prizes (including, without limitation, from the eStore) awarded to the User in connection with any League.

GENERAL CONDITIONS:

By entering a League, each User agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the League and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by Fantasy Feud in any manner whatsoever, including print, broadcast or the Internet. All entries become the property of Fantasy Feud, which assumes no responsibility for lost, delayed, incomplete or misdirected entries. Each League is subject to all applicable federal, provincial and municipal laws. The decisions of Fantasy Feud with respect to all aspects of any League are final and binding on all Users without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries. Without limitation, the employees or agents of Fantasy Feud, and its advertising and promotion agencies (the “Parties”) will not be liable for any failure of the website during any League; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Parties for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Further, the Parties will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in any League.

In the event of a dispute regarding who submitted an entry, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry. The sole determinant of the time for the purposes of a valid on line entry in any League will be the League’s server machine(s).

Fantasy Feud does not warrant that a User’s activities or the use of the Website Is lawful in any particular jurisdiction and Fantasy Feud disclaims all such warranties, including any express or implied warranty, including, without limitation, noninfringement, merchantability, fitness for a particular purpose and title.

Fantasy Feud reserves the right to withdraw or amend any League in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of Fantasy Feud that interferes with the proper conduct of this contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of a League is a violation of criminal and civil laws and should such an attempt be made, Fantasy Feud reserves the right to seek remedies and damages to the fullest extent permitted by law.

Fantasy Feud reserves the right to cancel or suspend any League, or to amend these Terms and Conditions without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind.

Fantasy Feud reserves the right, in its sole discretion, to deny access to any League and/or the e-Store to anyone at any time for any reason, whatsoever. The registration data that you must supply on the Website in order to access the e-Store and/or a League may include, without limitation, some or all of the following: (a) your full name; (b) e-mail address; (c) billing address; (d) daytime, evening and/or cellular telephone numbers; (e) credit card information; (f) at your option, your PayPal® account information; (g) date of birth; and/or (h) any other information requested on the applicable form (the “Registration Data”). You agree to provide true, accurate, current and complete Registration Data and to update your Registration Data as necessary in order to maintain it in an up to date and accurate fashion. Fantasy Feud will verify and approve all registrants in accordance with its standard verification procedures. During registration, you will be asked to provide a user name and password to use as your account log-in identification, where applicable (“Log-In”). If the Log-In that you request is not available, you will be asked to supply another Log-In. If Fantasy Feud approves your User application, Fantasy Feud will set up your specific account (“FF Services Account”). You are responsible for maintaining the confidentiality of your FF Services Account, Log-In and for restricting access to your computer, and you agree to accept responsibility for all activities that occur through use of your FF Services Account and Log-In.

By participating in any League (except where prohibited by law), each User agrees: (i) to hold Fantasy Feud, its affiliates, subsidiaries and divisions and the respective directors, officers, employees and assigns of each of the foregoing (each, an “Indemnified Party”) harmless against any and all claims and liability arising out of the User’s participation in the League or otherwise on the Website; (ii) to waive any and all right(s) to claim any loss or damage of any kind, including, without limitation, punitive, incidental and consequential damages, legal fees or any other damage(s) (other than actual out-of-pocket costs incurred to enter a League) against any Indemnified Party relating to the Website or any League.

By entering a League, each User expressly consents to Fantasy Feud, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering such League and in accordance with Fantasy Feud’s privacy policy, unless the User otherwise agrees.
